This is a tort action in which plaintiff seeks damages for the loss of his left eye eviscerated because of injury thereto when plaintiff was struck by a pellet from a shotgun fired by defendant during the course of an argument between the adverse parties to this litigation.

The lower court rendered judgment in favor of plaintiff in the sum of $3,859.50 from which award plaintiff has prosecuted...
