The defendant was convicted of statutory rape and the jury assessed his punishment at imprisonment in the penitentiary for a term of two years. His motion for new trial not having been presented to the court and acted upon within ninety days after its filing was overruled by operation of law and the defendant was sentenced in accordance with the verdict of the jury.
