Plaintiff has filed a complaint in trespass to which preliminary objections have been entered. According to the complaint the action is brought for the wrongful death of Dorothy H. Young which was caused, according to the complaint, by defendant's negligent operation of a rotary lawnmower.

The complaint reads:

"7. The defendant was negligent

"(a) In operating his rotary lawnmower on May 17, 1958 on his lawn...
