The facts appear from the following adjudication of

LEFEVER, J., December 7, 1959. — Under date of June 22, 1939, Frederick C. Scholler, settlor, executed an irrevocable deed of trust wherein he created the "Scholler Foundation". Settlor appointed himself, his sister, Ida M. Scholler, and Frederick C. Fuges, as trustees. The three trustees have died, and successors have been appointed in accordance with the procedure and requirements prescribed in the deed...
