This is an appeal from a judgment of the circuit court rendered on the verdict of a jury in a proceeding to condemn 5.73 acres of land in Shelby County for the construction of a public highway. The appellee commenced the proceeding in the probate court where an order of condemnation was entered awarding appellants compensation in the amount of $35,125.
