(1) Defendant assigns as error the failure of the court to nonsuit the action.

At the close of plaintiff's evidence defendant moved for nonsuit. The motion was overruled and defendant excepted. Thereafter defendant introduced evidence and plaintiff offered evidence in rebuttal.
