This case involves the habitual criminal act. ORS ch 168. The defendant appeals from a judgment imposing on him a ten year sentence permitted by ORS 168.031 which provides the penalty for one convicted of a fourth felony. Prior to conviction in the instant case the defendant was convicted of three crimes in Minnesota.
