This is an action to recover damages for personal injuries suffered by a minor child on July 31, 1955. The plaintiff, Willard Skaggs, Jr., a sixteen year old boy, became paralyzed from the neck down as a result of diving into an artificial pond on defendant John Junis' farm land when he allegedly struck his head on a submerged stump hidden from view beneath the water.
