Appeal from a judgment of the district court and from an order denying plaintiff's motion for a new trial.

The action arises out of a head-on collision on December 16, 1957, 4 1/2 miles north of Worthington, Minnesota, in which both drivers were killed. There were no witnesses as to the exact happening of the collision, which occurred between 8 and 9 a.m. on a clear morning, on a highway which is straight and level with no obstructions...
