The indictment herein charged the defendant in two counts as follows: (1) book-making and (2) keeping a place for the purpose of recording or registering bets or wagers. After a jury trial on June 13 and June 14, 1960, defendant was found guilty on both counts. Motion was promptly made to set aside the verdict. This was denied.

Defendant's counsel then moved in arrest of judgment on the second count contending that it failed...
