This is an appeal from a decree awarding to the intervenor, state of Oregon, title to certain land in Malheur county situate in the bed of the Snake river. The appellant is the counter-intervenor, Wilhemine Kiesel Shearman, individually, and as trustee for the Kiesel estate.
