This is an action in tort brought by the plaintiff, Herbert Toussaint, Jr., for the recovery of damages for personal injuries, suffering, medical bills and other losses allegedly received as a result of an accident which occurred on August 8, 1957, during plaintiff's employ as a cement finisher by the firm of Cudd & Burpo in the construction of a private road which it was building for Dow Chemical Company...
