Philip Clay Tilton was arrested upon a warrant issued pursuant to an information charging him with the offense of burglary in the second degree, committed in King county on May 17, 1958. Tilton pleaded not guilty and was released on bail. Early in the morning of October 23, 1958, Tilton allegedly participated in another burglary and was shot in the hand by a police officer when he attempted flight.

On the same day, at 2:30 p.m., Tilton's trial commenced...
