Appellant was found guilty by jury verdict of second degree murder. Appeal is taken from the judgment based on such verdict.

Appellant and his wife became estranged, and in February 1957 she commenced action against him for divorce. At that time there were two children, the issue of the marriage, and in addition a 13-year-old daughter of the wife by a former marriage. A fourth child was born...
