James Crockett Smithson, while driving a pick-up truck belonging to Moody Electric Company, Inc., on Highway No. 75 between Sherman, Texas and Denison, Texas, sustained injuries in an automobile collision from which injuries he subsequently died.

His surviving widow, appellee Mrs. Tomi L. Smithson, individually, and as next friend of her minor son, filed suit under the Workmen's Compensation...
