The plaintiff in error, hereinafter called the defendant, was convicted under an indictment charging burglary in the third degree, and sentenced to confinement in the State penitentiary for an indeterminate period of not less than three years nor more than five years, from which he has seasonably appealed to this Court, and assigned six grounds of error, which may be summarized as follows:
