ALPHA CONSTRUCTION COMPANY v. BRANHAM

337 S.W.2d 790 (1960)

ALPHA CONSTRUCTION COMPANY et al., Appellants, v. Elisha BRANHAM, Appellee.

Court of Appeals of Kentucky.

Rehearing Denied September 23, 1960.

Attorney(s) appearing for the Case

C. Kilmer Combs, Prestonsburg, J. K. Wells, Paintsville, for appellants.

Jack T. Page, F. Dale Burke, Pikeville, for appellee.

CLAY, Commissioner.

While plaintiff appellee was riding a horse on a highway he received serious personal injuries in a collision with defendant's truck. A judgment of $25,000 was recovered. Appellant's principal contention on this appeal is that it was entitled to a judgment notwithstanding the verdict because its driver was not negligent, or if so, the plaintiff was contributorily negligent as a matter of law.
