This is an appeal from the judgment of the trial court favorable to appellee rendered in response to appellee's motion for summary judgment.

Appellant sued appellee, Ralph Chiles and V. L. Mullins for damages resulting when his home in Pasadena was damaged by fire on February 21, 1958.
