We affirm in open court the order of the District Court for the Southern District of New York granting the government's motion under Rule 46(f) (3) of the Federal Rules of Criminal Procedure, 18 U.S.C.A., for entry of judgment against Public Service Mutual Insurance Company upon a forfeiture of a $5,500 bail bond. The bond was for the appearance of Thomas Simmons to answer an indictment charging violation of the narcotic laws. Simmons went to trial on...
