In this action plaintiff, a special charter city, condemned Lots 163 and 164 in the "Original Town of Liberty" for "off-street parking of motor vehicles." The commissioners awarded defendant damages in the sum of $48,720 for the appropriation of said property and he filed exceptions to that award. The subsequent trial in the circuit court resulted in a verdict and judgment for defendant in the amount of $52,000 and he has duly appealed therefrom...
