This case was before this Court at the Fall Term, 1957. Good Will Distributors (Northern), Inc. v. Shaw, 247 N.C. 157, 100 S.E.2d 334. Subsequently James S. Currie, Commissioner of Revenue, was, by consent, substituted as party defendant for former Commissioner Eugene G. Shaw.
