This is an appeal from a summary judgment rendered wherein appellee, Carlos Gonzales, filed suit on June 6, 1958 in the nature of a trespass to try title against appellant, Clarence Jones, and two other defendants, D. E. Basden and Jerry Basden, but the suit was actually for the recovery of leased premises and for damages in the amount of the rental value thereof from April 11, 1958 upon a claim that the release had terminated.
