This matter is before us on an appeal taken by the plaintiff in a petitory action from a judgment of the district court which dismissed her suit. By motion filed with us representing that the defendant, A. Dennis Landry, died on October 18, 1958, the latter's widow, Mrs. Gussie Rodemacher Landry, individually and as natural tutrix of her minor children Judy, Ted and Kent Landry, was substituted as party defendant.
