The indictment in this case contained two counts. The first count charged Richard Calvin Price with the possession of non-tax-paid whiskey, and the second count charged him with the concealment of non-tax-paid whiskey with the intent to evade and defeat the assessment and collection of the tax thereon imposed by law. A motion was filed in the case to quash the indictment, suppress certain evidence, and compel the return of certain seized property...
