Plaintiff in error who will be referred to as defendant was charged in an information with the theft of a shetland paint mare, the property of Robert L. Platt. He entered a plea of not guilty and upon trial in January, 1957 the jury was unable to agree on a verdict. A second trial in May, 1957 resulted in a verdict of guilty upon which sentence was imposed.
