The offense is driving while intoxicated; the punishment, three days in jail and a fine of $50.

Highway Patrolman Duran testified that at 8:10 p. m. on the night in question he saw the appellant standing beside his automobile which had gone through a barbed wire fence and was sitting out in a pasture, that the appellant told him he was alone and another automobile which he was meeting "sideswiped him" and "knocked him into the ditch...
