This is a motion by defendant pursuant to Rule 56 of the Federal Rules of Civil Procedure, 28 U.S.C.A., for summary judgment.

On February 16, 1955, plaintiff filed an application for old-age insurance benefits, and also filed an application for insurance benefits for his two children on the plaintiff's wage record.
