This is an action of assumpsit to recover damages for an alleged breach of warranty of title to a certain automobile sold by the defendant to the plaintiff. The case was tried before a justice of the superior court sitting without a jury and resulted in a decision for the plaintiff for $2,530.75. It is before us solely on the defendant's exception to such decision.
