GARFIELD, Justice.

Defendant was indicted by the grand jury of Polk county for receiving stolen property of the value of more than $20, as defined in section 712.1, Code 1954, I.C.A. He entered a plea of not guilty, was tried before court and jury and found guilty. His motion for new trial was overruled and he was sentenced to confinement in the men's penitentiary at Fort Madison for an indeterminate time not exceeding five years.
