HERNDON, J.

This is an appeal from a judgment dismissing the action as against defendant-respondent Paul Shliff. The dismissal was ordered pursuant to section 581, subdivision 3, of the Code of Civil Procedure, plaintiffs having failed to amend their third amended complaint within the time allowed by the court in an order sustaining a demurrer to said complaint on the ground that there was a misjoinder of parties plaintiff.
