Geedie Colbert brought this suit against Ellis Eubanks for damages because of personal injuries alleged to have been sustained when the vehicle in which he was riding was struck by a police car owned by the City of Big Spring and operated by Eubanks, who at the time was on police patrol and in the course of his employment as a policeman. The case was tried before a jury which found that the defendant failed to have his police car under proper control...
