Clifford Daugharty, plaintiff-appellant, (hereinafter referred to as "petitioner") was convicted on November 19, 1951, in the circuit court of Deschutes County of the crime of uttering a forged check drawn on the Eugene Branch of the United States National Bank of Portland. On November 20, 1951, petitioner was sentenced to a term of 15 years in the Oregon State Penitentiary.
