This is an appeal by the plaintiff and cross-defendant (hereinafter referred to as "appellant") from a judgment rendered in favor of the defendant and cross-complainant (hereinafter referred to as "respondent") for breach of contract.

The case was heard without a jury and respondent was awarded a judgment in the sum of $4,330.61 on his cross-complaint.
