PRESCOTT, J., delivered the opinion of the Court.

The question involved herein is a narrow one and not difficult of solution. It is simply whether the Circuit Court for Montgomery County (Judge Duer, specially assigned) was correct in reversing, upon the ground of estoppel by judgment, or res judicata, the action of the State Tax Commission which had denied an exemption from taxation of certain real estate.
