Defendant was indicted on two counts of violating section 580 of the Business and Professions Code. In count I it was alleged that on February 28, 1957, he "offered to sell a medical and osteopathic degree"; in count 2, that on March 26, 1957, he "sold a medical and osteopathic degree." The jury found defendant guilty on each count. He moved for a new trial and arrest of judgment. Both motions were denied. Proceedings were suspended and defendant was placed...
