PALMIERI, District Judge.

On June 12, 1958 plaintiff filed a complaint in this Court, seeking recovery from the defendant for injuries which he allegedly sustained while employed as a seaman aboard its vessel. The complaint also claims damages for alleged aggravation of plaintiff's injuries because of "certain medical and operative intervention subsequent thereto, related and consequent to the fault of the defendant."
