Carvelo, petitioner, is a prisoner confined in Oahu Prison under a sentence imposed on him by the circuit court of the first circuit upon his conviction for burglary in the first degree. He was jointly indicted with Richard Kahalewai, Franklin Jackson and Richard Gushikuma, all of whom were convicted of the same crime.
