YOUNG, Justice.

By this suit, appellee, father of Kenneth Wayne Fontaine, sought to modify that portion of a divorce decree awarding custody of the child to the former wife and mother to the end that such custody be given to him. On ex parte hearing he had secured temporary possession and on trial to the merits, final custody was taken from Syble Mae Fontaine and placed in Thomas J. Fontaine, subject to the former's right to have the child with her during the summer...
