Order unanimously modified on the law to the extent of denying the motion for summary judgment made by the Brenner plaintiffs and granting summary judgment to the City of New York dismissing the complaint as to these plaintiffs, and otherwise affirmed, with $20 costs and disbursements to the defendant-appellant-respondent, the City of New York.
