The defendants, other than the defendant insurance company, seek to dismiss the complaint herein as against them, pursuant to subdivision 4 of rule 107 of the Rules of Civil Practice, upon the ground that there is an existing final determination of a court of competent jurisdiction rendered on the merits, determining the same causes of action between the plaintiffs and the movants.
