This is the second appeal in this case. The suit involves a policy of burial insurance.

Originally the complaint contained two counts. On the first trial in the court below, the cause was submitted to the jury upon Count 2 of the complaint, and resulted in a verdict for the plaintiff for $1,000. On appeal, the Court of Appeals held that Count 2 was demurrable and reversed and remanded the cause to the Circuit Court of Jefferson County...
