Counsel for the appellee heretofore filed in this cause a motion to require the City of Miami Beach to post a supersedeas bond in order for the appellant-city to stay the effect of a peremptory writ of mandamus issued to said city in the circuit court. Thereupon this court entered its order filed December 14, 1958, allowing said motion to be withdrawn and provided for the acceleration of the appeal.
