This is an appeal from an order of the Circuit Court for Multnomah County ordering that the defendant be imprisoned in the Oregon State Penitentiary for violation of probation.

The defendant, Fred B. Ludwig, a real estate broker, was indicted for and pleaded guilty to the charge of larceny by embezzlement. On April 24, 1955, he was sentenced to a maximum of two years in the Oregon State Penitentiary. At the same time...
