Defendant Ford Motor Company1 has filed a motion for summary judgment under Rule 56, 28 U.S.C.A.

Plaintiff Joe E. Boop2 instituted this action in the Marion County Superior Court in January, 1956, naming as defendants Dearborn Motors Corporation3 and Ford. Dearborn was never served and has not appeared. Ford removed the case to this Court.
