This is an appeal from a judgment dismissing plaintiff's suit with prejudice. The action was instituted on February 6, 1957 by the filing of plaintiff's petition, in which it was alleged that on February 9, 1952, plaintiff paid over to defendant the sum of $1,000 for the purchase of a one-third interest in an Aberdeen-Angus cow; that defendant took the $1,000 and converted it to his own use; that defendant did not make over the one-third interest...
