Defendant was sued by plaintiff, an employee of Vinnell Company, a corporation, for damages arising out of an industrial injury in its steel plant. Pope, vice president of the corporation, was sued individually although Vinnell Company was not joined as a party defendant, plaintiff having exhausted his remedies against it under the compensation provisions of the Labor Code.
