The plaintiff had been in the logging business since he was fourteen years of age and was an owner and operator of a logging business.

On February 1, 1955, Henry Krause delivered a load of logs to the defendant company at Marathon City. Krause drove into the yard and an employee of the defendant directed him to unload the logs 15 to 18 feet north of the planing mill.
