Plaintiff in error, herein referred to as defendant, was convicted in the district court of Garfield County on an information charging confidence game as defined by C.R.S. '53, 40-10-1. He was sentenced to the State Penitentiary for a term of not less than ten nor more than fifteen years. The appearance of plaintiff in error in this Court was pro se. The participation of his counsel was limited to the filing of a reply brief.
