We have before us for disposition on the present appeal two separate suits which were consolidated for trial in the lower court. The first suit was for replevin of a truck, instituted in the General Sessions Court of Tipton County by Paul Pickard, as agent of C.D. Demery, against Homer Ferrell and J.W. Turnage.
