Ferrell, instituted her action of trespass on the case in the Court of Common Pleas of Kanawha County, against The Royal Crown Bottling Company of Charleston, West Virginia, for damages alleged to have resulted from an injury occasioned by an exploding bottle containing a carbonated beverage, manufactured and bottled by defendant.
